Board of Zoning Appeals

The Board of Zoning Appeals (BZA) grants the following variances and permits:

Area Variance
The authorization by the Board to use the land in a manner that is not allowed by dimensional or physical requirements of the applicable zoning regulations.

Use Variance
The authorization by the Board to use the land for a purpose that is otherwise not allowed or is prohibited by the applicable zoning regulations.

Special Use Permit
Uses that have some special impact or unique form are designated Special Uses.  These require a careful case-by-case review of their location, design, configuration and impact to determine, against fixed standards, whether to permit their establishment on any particular site.
Expansion or alteration of special use permit:
  • A new special use permit shall be required for any expansion or alteration of a use already authorized by a special use permit. A request for such a permit shall be subject to the application and review procedures.  
  • The Board may suspend, revoke or limit a special use permit if the Board finds that the special use is being conducted or operated in violation of any conditions that may have been imposed. Such action shall be on the basis of a public hearing, appropriately noticed in accordance with the provisions of the zoning ordinance.
Parking Lot Permit
The authorization of the Board is required to park, store or garage more than 4 vehicles.

Interpretations
The Board may interpret any provision of the applicable zoning regulations.  Matters interpreted by the Board include but are not limited to the following:
  • The exact location of any district boundary.
  • Whether a specific use is permitted in a district.
  • Whether a use qualifies as a legal nonconforming use.
  • Whether a proposed use may replace a nonconforming use.
  • Whether a proposed use that is not sp
